INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA

1. Data Processing and Data Processing Purposes  

1.1 Diana Shipping Services S.A. (hereinafter: «the Company»), pursuant to the applicable national and European legislation on data protection, and especially with Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter the “General Data Protection Regulation” or “GDPR”), and in its capacity as a data controller, hereby informs you with respect to the processing of personal data it conducts in the context of your application.  

1.2 More specifically, in the context of your application, the Company processes personal data that either you or third parties (such as recruitment agencies, job-posting websites and/or your previous employer) provide, including without limitation personal details, such as name, address, telephone number, e-mail address, date and place of birth, passport/ID number, recruitment details, such as information about your education and previous and current employment and interview notes, as well as criminal records provided by you to the Company (if you become a short-listed candidate).

1.3 The Company processes your personal data during the assessment of your application and for a maximum period of six (6) months, while such processing may extend to two (2) years after the receipt of your application, if you specifically consent thereto or in order for the Company to comply with its legal obligations and/or for the establishment, exercise and/or support of legal claims.  

1.4 The Company processes your data on the following legal grounds: (a) to comply with its legal obligations, (b) to take steps at your request prior to the execution of your employment contract, (c) satisfy its legitimate interests, such as to assess candidates to ensure its proper operation in accordance with its employee-related procedures, to fulfill its staffing needs, and to comply with its legal and contractual obligations, (d) for the establishment, exercise or defense of eventual legal claims by the Company, (e) to assess your fitness for the specific position or work duties, where applicable, and/or (f) to process your personal data on the basis of your consent.  

1.5. The Company processes your data for the following purposes of processing: (a) to assess your application, (b) for the purposes of the legitimate interests pursued by the Company, such as, for example, to manage the organizational functioning of the Company, to fulfil its staffing needs, to ensure the safety of the vessels it manages and of its premises, for disciplinary, health, safety and security reasons, (c) to comply with legal obligations that we are subject to, and (d) to establish, exercise or defend legal claims involving you that may arise.

2. Transfer of personal data to third parties

We might share your personal information internally, in order to assess your application. We might also share your personal information with the competent authorities, if required by law. If you are recruited through a recruitment agency, we may transfer your data to the recruitment agency, provided that a legal basis for such transfer exists.

3. Your rights

Pursuant to the relevant requirements of the GDPR, you have the right to: (a) be informed and request access to your data and to information relating to the processing thereof by the Company, (b) request corrections and/or the completion of your data, (c) request the deletion of your data, (d) request the restriction of the scope of processing and the way and/or purposes for which we process them, (e) receive the data you provide to the Company and transmit them and/or request their transmission to another data controller, (f) object to the processing of your data, (g) file a complaint before the competent supervisory authority (such as the Hellenic Data Protection Authority by email to complaints@dpa.gr), and (h) so far as the processing relies upon your consent, withdraw such consent. To exercise your rights, please contact the Company.
